When are Assessment Notices for the upcoming Calendar year mailed?

Assessment notices are mailed after the final budget has been approved by the board which is generally in the first part of December.

When are Unit One Assessments Considered Delinquent?

Spanish Wells Unit One Assessments are considered delinquent as of January 30th. Any owner who is delinquent in monies owed to the Spanish Wells Unit One HOA will be assessed a late fee as of that date plus interest going forward until the balance is paid in full. Should the account remain unpaid as of the end of February the account will be turned over to the Spanish Wells Unit One HOA’s attorney for collection and all collection costs will become the responsibility of the owner.


When Does the Board Place a Lien on a Property?

When a homeowner’s outstanding balance exceeds $1,000 for assessments, fines, interest and late fees and is unresponsive to the collection efforts of the Spanish Wells Unit One HOA’s attorney.

What are the collection Days for Landscaping Waste and Garbage\Recycling?

Landscaping waste is picked up every Tuesday and Garbage\Recycling on Fridays.

What projects require an ARC?

The following list is not an exhaustive list but some of the must common projects requiring the completion of an ARC:

Exterior Painting of any nature ( i.e. whole house, trim, garage doors, front doors, etc.)
Roof Replacements
Driveway Replacements
Pools
Exterior Building Modifications ( i.e. windows, garage doors, lanai’s, walkways, elevation modifications, etc.)
landscaping Changes ( i.e. new gardens, tree removal\planting, etc.);
Lot Elevation Changes ( i.e. the addition of any fill to a lot).

Who is responsible for Mailbox Maintenance\Replacement?

Homeowners are responsible for all mailbox maintenance and replacements. Should a mailbox require replacement the Spanish Wells Unit One HOA has a small inventory of approved mailboxes that can be purchased.


When are Vendors Not allowed in the Community?

Vendors are not allowed to work beyond 6pm Monday thru Friday, Saturday to 4 pm and at no time on Sundays unless there is a unique emergency that must be attended to ( i.e. hurricane clean up, fire restoration, etc.)

What issues do I contact Spanish Wells Unit One’s SWCA Rep versus the Unit One Board?

Following are the issues the Spanish Wells Unit One SWCA Rep should be contacted on for assistance:

What signs are allowed?

The only signs that are allowed are “for sale” signs. No other signs are permitted.

How do I give gate permission to a guest or vendor?

You need to create an account on the following website: www.swca.biz

Once created go to the home page where you will see in the upper right hand section of the page a section that says “What would you like to do” under that section click on “Review my Guest List” . Once on the page in the upper right hand corner click on “add guest” and then on the page that opens click the carrot under “Select Pass Type” and complete the remainder of the information.

Who is responsible for maintenance on the SWCA Road common area?

The homeowner is responsible for maintenance of the SWCA road common area. As a general guideline this area is from the Bonita Springs Water Utility water meters on your property to the road. The homeowner is responsible for maintaining the swells to ensure they are not filled in, that no trees are planted in the swell, that the grass is cut, watered and free of weeds, and if a culvert is installed during driveway replacement that it be a minimum 12” in diameter with 18” recommended.

Are there any Utility easement concerns that I should be aware of?

For all properties in Unit One there is a six foot easement on either side of your property lines as well as a ten foot utility easement in the rear. Accordingly if plantings are made in this area and a utility company needs access they will be removed and the property owner will be responsible for replacement and restoration.

Can overnight guests stay in my house when I’m not present?

Yes overnight guests may stay in your house without notice to the Association if the period of guest occupancy is not more than seven (7) days. Such seven (7) day occupancies without notice to the Association are limited to two (2) occupancies per calendar year. Overnight guests in the absence of the Owner for occupancy periods of more than seven (7) days require notification to the Association ten (10) days prior to the commencement of the occupancy. Notification shall include the names, addresses and contact information for each individual Guest occupant. Approval for such occupancy rests with the Board of Directors.

What is the minimum rental period of a home allowed by the Spanish Wells Unit One HOA?

The minimum rental period a homeowner is allowed to rent their home is thirty (30) days with no exceptions. Any violations of this requirement will result in the homeowner being fined $100 a day, per occupant, with property liens being placed on any unpaid fines.
